Amazon Price Fixing

1. Strosberg Wingfield Sasso LLP and Orr Taylor LLP are counsel in a proposed class action against Amazon.com, Inc., Amazon.com.ca, Inc., Amazon.com Services LLC, Amazon Services International, Inc., and Amazon Services Contracts, Inc. (collectively, “Amazon”).

2. The action is advanced on behalf of three proposed classes from 1 June 2010 to the present: Amazon E-Commerce Class: All persons or entities in Canada who purchased products on Amazon.ca or Amazon.com. Excluded from the Amazon E-Commerce Class are the defendants and their parent companies, subsidiaries, and affiliates.

Other E-Commerce Class: All persons or entities in Canada who purchased Amazon Products on any website other than Amazon.ca or Amazon.com. Excluded from the Other E-Commerce Class are the defendants and their parent companies, subsidiaries, and affiliates.

Umbrella Class: All persons or entities in Canada who purchased products from on any website other than Amazon.ca or Amazon.com which products are not Amazon Products. Excluded from the Umbrella Class are the defendants and their parent companies, subsidiaries, and affiliates.

Amazon Products are all categories of products that are sold by third-party sellers on Amazon.ca or Amazon.com.

3. The plaintiffs allege that Amazon conspired to artificially inflate the prices for retail e-commerce across Canada through anticompetitive agreements. These agreements prohibit third party sellers from selling products to consumers on any e-commerce website, other than Amazon.ca or Amazon.com, for a price lower than the price the third party sellers charge for the same products on Amazon.ca or Amazon.com.

4. The certification motion was heard in the Federal Court on October 24-26, 2022. The decision is currently under reserve.
